TITANS REALM LTD — TERMS OF SERVICE

OVERVIEW

These Terms of Service govern your use of the Titans website and online store (the "Services"), operated by Titans Realm LTD ("we", "us", "our"). The Services are hosted on Shopify.

By visiting, browsing or purchasing through the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

SECTION 1: ACCESS AND ACCOUNT

We aim to represent our products accurately. However, colours and product appearance may vary depending on your device and display settings. We do not warrant that the appearance or quality of any product will exactly match what is shown on the Services.

Product descriptions are subject to change at any time. We reserve the right to withdraw any product from sale and to limit quantities available to any individual, region or jurisdiction at our discretion.

SECTION 3: ORDERS

Placing an order constitutes an offer to purchase. Titans Realm LTD reserves the right to accept or decline any order at its discretion. Your order is not accepted until we confirm it and process your payment. Please review your order carefully before submitting. Once accepted, we may be unable to accommodate cancellation requests.

If we decline, amend or cancel your order, we will notify you using the contact details provided at checkout.

All purchases are subject to our Returns and Exchanges Policy.

You confirm that purchases are for personal or household use only and not for commercial resale or export.

SECTION 4: PRICES AND BILLING

Prices, discounts and promotions are subject to change without notice. The price charged will be the price shown at the time your order is placed, as confirmed in your order confirmation email. Unless expressly stated, prices do not include taxes, shipping, customs or import charges.

Where a promotion conflicts with these Terms, the promotion terms will apply.

You agree to provide accurate and complete payment information. You confirm that you are authorised to use the payment method provided and that all charges will be honoured.

SECTION 5: SHIPPING AND DELIVERY

All delivery times are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs processing or circumstances outside our control. Risk of loss and title pass to you once we transfer your order to the carrier.

All content on the Services, including trademarks, text, images, graphics, video and audio, is owned by Titans Realm LTD or its licensors and is protected by UK and international intellectual property law.

You may use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, publish or transmit any material from the Services without our prior written consent. All rights not expressly granted are reserved.

Titans and all related names, logos and marks are trademarks of Titans Realm LTD. Shopify's trademarks remain the property of Shopify Inc. Unauthorised use of any trademark is prohibited.

SECTION 7: OPTIONAL TOOLS

We may provide access to third party tools through the Services. These tools are provided "as is" and "as available" without warranty or endorsement. We have no control over third party tools and accept no liability for their use. Your use of any such tools is entirely at your own risk.

New features and tools may be introduced to the Services in future and will be subject to these Terms when they are.

The Services may contain links to third party websites. We are not responsible for the content, accuracy or practices of any third party site. Accessing third party sites is at your own risk. Any complaints about third party products or services should be directed to the relevant third party.

SECTION 9: RELATIONSHIP WITH SHOPIFY

Titans Realm LTD is powered by Shopify. All sales and purchases made through the Services are made directly with Titans Realm LTD. Shopify is not responsible for any aspect of transactions between you and Titans Realm LTD, including any loss, damage or injury arising from purchased products or services. You release Shopify and its affiliates from all claims arising from your transactions with Titans Realm LTD.

SECTION 10: PRIVACY

All personal data collected through the Services is handled in accordance with our Privacy Policy. By using the Services, you confirm that you have read and understood it.

As the Services are hosted by Shopify, Shopify also collects and processes certain data in connection with providing the platform. This is subject to Shopify's own Privacy Policy. Data you submit may be shared with Shopify and its partners, including those located outside the UK.

By submitting any feedback, reviews, ideas or suggestions through the Services, you grant Titans Realm LTD a perpetual, worldwide, royalty free licence to use, reproduce, modify and distribute that content for any purpose, including commercial use.

TO THE FULLEST EXTENT PERMITTED BY LAW, TITANS REALM LTD, ITS PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THEM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under UK law.

SECTION 17: INDEMNIFICATION

You agree to indemnify and hold harmless Titans Realm LTD, Shopify, and their respective affiliates, officers, directors, employees and agents from any claims, losses, damages or legal fees arising from your breach of these Terms, your violation of any law or third party rights, or your use of the Services.

We will notify you of any such claim. We may control the defence at your cost but will not settle any claim that imposes non-monetary obligations on you without your consent.

SECTION 18: SEVERABILITY

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be severed and the remaining Terms will continue in full force.

SECTION 19: ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Titans Realm LTD regarding your use of the Services. Our failure to enforce any provision does not constitute a waiver of that provision.
